Alligators Always TOS & Conditions

IT IS AGREED AS FOLLOWS:

Buyer agrees with the seller ALLIGATORS ALWAYS to pay the down payment stated based on the purchase before any work has started on the making of the custom product. The Buyer agrees to pay off the full price of the product based on purchase before the product can be received.

 

AGE AUTHENTICATION

The buyer agrees to show an I.D. to ensure the identification of age, being 18 years or older. If you are a minor, ALLIGATORS ALWAYS requires that you have parental/guardian consent before commissioning. This will require their own signature, I.D. and face to be shown via a picture and/or video file agreeing to consent. If at any point ALLIGATORS ALWAYS finds out that you lied about your age, all progress will halt and follow the cancellation of a commission.

CANCELLATION OF COMMISSION

If at any point and time during the commission the Buyer decides to cancel the commission, no refund will be given for the price of materials and the product will be completed with a different appearance than the given reference and sold as a pre-made item instead. If the buyer cancels before the down payment is received, no fees apply. If the Buyer cancels after work is completed, only a portion will be refunded as equal to the amount of time not worked on the product.

 

COMPLETION AND DEADLINES

Due to a physical and mental impairment, we do NOT give completion dates.  We can give a very rough estimate, but it is NOT GUARANTEED. We do not do convention/ rush order completion dates as well.

Please be aware that we do have a queue. We cannot bump you up. Our trello changes due to payments completion.

We do not want to rush our work, we only want to give you the best we can.

 

SHIPPING

Shipping costs are not included in the costume quote. Shipping costs may vary, and it is recommended that the buyer pays extra for shipping insurance. ALLIGATORS ALWAYS has the right to choose the shipping method and carrier. ALLIGATORS ALWAYS  is NOT responsible for any lost or damaged items. Shipping quotes are not given until the product is finished. Please keep in mind that the box needs to be measured and weighed in order to get the exact quote.

 

REFUSAL OF SERVICE

ALLIGATORS ALWAYS has the right to refuse service to anyone for any given reason. This can include rude, unreasonable, persistent, and threatening clients.

 

Harassment will not be tolerated under any circumstances. Should the buyer show any signs of harassment (as determined by ALLIGATORS ALWAYS), ALLIGATORS ALWAYS has the right to decline the commission and cease work on it with no warning. The Commission will then follow the terms and conditions outlined in the Cancellation of Commission process.

Hostilities may result in a cancellation of commission and or further actions including but not limited to: blocking, reporting, and other actions if deemed necessary. If ALLIGATORS ALWAYS has to block and cease contact with the Buyer for our own safety, this forfeits their commission and a refund due to the severity of their behavior.

 

ALLERGY WARNING

Please be aware that in the makers vicinity there are dogs and cats. Although ALLIGATORS ALWAYS does their best to maintain a clean area, pet fur can still be present.

 

CONCEPT

A reference of the character must be given before the product can be started. ALLIGATORS ALWAYS is not responsible for missing details on the custom product that are not present on the reference image(s).

DESIGN CHANGES

Once the contract is signed, there will be no changes to the design. If the Buyer wishes to use a different design/character they must fill out a new contract and terminate the current one.

 

WIP PHOTOS AND PROGRESS

During the process of making the custom product, Work In Progress photos will be sent to you via an instant messaging application. (i.e. email, Messenger, Telegram, Twitter, etc.)

The buyer will pay close attention to these photos to ensure that the product is produced as the reference depicts. If the buyer sees something that needs to be changed (based on the reference given), they will notify ALLIGATORS ALWAYS as soon as applicable. ALLIGATORS ALWAYS is not responsible for any corrections the buyer fails to make after seeing a WIP photo.

 

COMMUNICATION

Please be aware that ALLIGATORS ALWAYS cannot answer all the time. We do have to focus on our work, and we get a lot of messages daily. Our commissioners are top priority, but this still applies to them as well. We do not ignore, but we will answer as soon as we can.

(This means you consent to AlligatorsAlways sending you messages electronically, all messages sent will be treated as if they were written in person by you, and I won't share your contact information anywhere else.)

 

USER CONSENT TO RECEIVE COMMUNICATIONS IN ELECTRONIC FORM

 

For contractual purposes, you: (a) consent to receive communications from us in an electronic form via the email address or other social media messaging you have submitted; and (b) agree that all Terms of Use, agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing. The foregoing does not affect your non-waivable rights.

WARRANTY

All work after completion and delivery is guaranteed a 30 day warranty covering defects of material and construction. The warranty does not cover normal wear and tear (Determined by ALLIGATORS ALWAYS) or damage due to neglect and care for the custom product. (i.e. water damage, being crushed, stains, etc.) Any alterations that are unauthorized and not made by ALLIGATORS ALWAYS will void the warranty.)

You must pay all shipping fees if you would like it repaired. We have the right to decline repairs due to scheduling. After a year of purchase, we will charge a small fee to repair any damages. Please take good care of your product.

 

PAYMENT

Upon approval, buyer is expected to:

a) pay a down payment/in full for the product. Should the buyer fail to pay the amount needed in the amount of time given, the product will be canceled and follow the conditions of cancellation of a commission.

Or

b) Buyer has agreed to conduct a payment plan of ($x) USD a month (starting Date) until the product has been paid off. Should the buyer fail to pay the amount needed in the amount of time given, the product will be canceled and follow the conditions of cancellation of commision. A credit system will also be in place, whenever the buyer pays more than said amount a month, any extra money will be added onto the next months payment should they be unable to make full payment, but still requiring to meet the total per month.

 

Our forms of payments are:

  • Paypal

  • Square

  • Cash (in person if applicable)

In United States Dollar Currency

 

Payment must be paid in full before any work will be started.

 

CONTRACT

By signing below, both parties are stating that they have read and agreed to the Terms of Use and Conditions that apply. If Buyer fails to meet the requirements,  then they understand that their order can be terminated.
